  1. Operator: This website is operated by Excess Auto Spares Kenya (“we,” “us,” or “our”).

  2. Applicability: These Terms apply to all visitors, registered users, mechanics, garages, and customers who access or purchase products through our online store or communication channels.

  3. Amendments: We reserve the right to update, modify, or replace any part of these Terms at any time. Changes take effect immediately upon posting to the Site. Continued use of the Site after updates constitutes acceptance of the modified Terms.

2. Eligibility & Account Creation

  1. Legal Capacity: By using this Site, you represent that you are at least 18 years of age or accessing the Site under the supervision of a legal guardian, and possess the legal capacity to enter into binding agreements under Kenyan law.

  2. Account Responsibility: If you register an account, you are responsible for maintaining the confidentiality of your credentials and restricting access to your device. You accept full responsibility for all activities that occur under your account.

  3. Accuracy of Information: You agree to provide current, complete, and accurate registration, delivery, and contact information for all purchases made on our Site.

3. Products, Pricing & Availability

  1. Product Descriptions: We make every effort to display product details, specifications, and images as accurately as possible. However, we do not warrant that product images, compatibility lists, or descriptions are completely error-free.

  2. Compatibility & Fitment: Customers are responsible for verifying that a spare part is compatible with their vehicle before completing a purchase. Providing your vehicle’s Chassis Number / VIN to our team (+254 722 591 932) before purchasing reduces fitment errors.

  3. Pricing: All prices are listed in Kenyan Shillings (KES) and are inclusive of statutory Value Added Tax (VAT) where applicable, unless explicitly stated otherwise.

  4. Price & Stock Changes: Prices and inventory availability are subject to change without prior notice. We reserve the right to modify or discontinue any product or service without liability.

4. Orders & Payment Terms

  1. Order Acceptance: Receiving an online order confirmation does not signify our final acceptance of your order. We reserve the right to cancel or limit orders due to stock unavailability, pricing errors, or suspected fraud.

  2. Payment Methods: Payments can be made via M-Pesa (Paybill / Till Number), Direct Bank Transfer (EFT/RTGS), or authorized Credit/Debit Card payment gateways integrated on the Site.

  3. Full Payment: Orders will only be processed, packaged, or dispatched once full payment has been received and verified.

5. Shipping, Delivery & Store Pickup

  1. Delivery Regions: We offer nationwide dispatch across Kenya via third-party courier services, direct drivers, or parcel logistics.

  2. Delivery Timelines: Estimated delivery times (e.g., same-day in Nairobi, 24–48 hours countrywide) are guidelines and not guaranteed. Delays caused by third-party logistics, weather, or transit disruptions are beyond our direct control.

  3. Risk of Loss: Risk of loss and title for all products purchased pass to you upon delivery to the carrier or upon pickup from our premises.

6. Returns, Exchanges & Refunds

  1. Return Period: Eligible items may be returned or exchanged within seven (7) days from the date of delivery or pickup.

  2. Condition of Returned Items: Returned parts must be unused, uninstalled, free of grease/oil stains, and in their original, undamaged manufacturer packaging.

  3. Ineligible Returns: Electrical components, specialized sensors, fluid products with broken seals, and custom-ordered items are non-returnable unless proven to be manufacturing defects upon arrival.

  4. Return Logistics: Unless the return is due to an error on our part (e.g., dispatching the wrong part), shipping fees for returned items are the responsibility of the customer.

7. Warranty Policy

  1. New Parts (OEM & Aftermarket): New parts carry manufacturer warranties against material or manufacturing defects, subject to proper installation by a qualified automotive technician.

  2. Ex-Japan Parts: Pre-owned assemblies (engines, gearboxes) carry a limited startup/testing warranty.

  3. Voided Warranty: Warranties are void if a part fails due to improper installation, misuse, alteration, off-road racing, or lack of proper vehicle maintenance.

8. Intellectual Property

All content on excessautospareskenya.co.ke—including text, logos, icons, product images, graphics, digital downloads, and software—is the property of Excess Auto Spares Kenya or its content suppliers and is protected by Kenyan and international intellectual property laws. Unauthorized reproduction or commercial use is strictly prohibited.

9. Limitation of Liability

  1. Excess Auto Spares Kenya shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use of our products or Site services.

  2. We are not liable for vehicle damage, labor costs, towing charges, or loss of income resulting from part failure, delayed delivery, or incorrect installation. Our total liability for any claim shall not exceed the purchase price of the specific product in question.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the Laws of the Republic of Kenya. Any dispute, controversy, or claim arising out of or in connection with these Terms or your use of the Site shall first be resolved through good-faith negotiation. If unresolved, it shall be submitted to the competent courts of Kenya.
